Department for Commercial Affairs performs the following operations: identification of state roads users, recording the current debits, document systematization, as well as monitoring and realization of charge collection process in the following manner:

  • one-time fees for the construction of facilities with access from state roads, fees for access road connection to the state road and fees for placement of installations on state roads
  • annual fees for placement of advertising billboards and devices for visual or audio advertising on a public road, rental fees for a portion of the road land strip or any other land used by the Enterprise, fees for construction and use of commercial objects having an access from state roads.

Department for Commercial Affairs includes the following Divisions:

  1. Division for Monitoring the Charge Collection– in charge of the certificates issuance and recording the existing commercial objects (petrol stations, motels, catering facilities, advertising boards and devices for visual or audio advertising or announcing on public roads, i.e. any other land used by the public road manager in compliance with the regulations),
  2. Division for Charge Collection of Approval Issuance and Provision of Services– in charge of surveying field conditions and recording commercial objects (petrol stations, motels, catering facilities, advertising boards and devices for visual or audio advertising or announcing on public roads, i.e. any other land used by the public road manager in compliance with the regulations), recording the electronic toll collection, issuance of free and prepaid tickets for highway users, charge collection for state road usage for foreign vehicles and charge collection for special transport.

COMMERCIAL ACTIVITIES

Special Transport

kamionSpecial transport is defined as transport by a vehicle which alone or with load exceeds the allowed axle load, total weight, width, length or height, as determined by the regulations and pursuant to Article 2. of the Law on Public Roads, which is being applied since January 01, 2006.

Pursuant to Article 48. of Law on Public Roads, the Special transport,  within the road transport on the territory of the Republic of Serbia, i.e. within the international road transport, can be carried out on public roads on the basis of a special licence issued by the public roads’ manager for each individual transport, which specifies the transport method and conditions, as well as the amount of special transport fee.

Fee for state road usage for foreign vehicles

 On behalf of the Public Enterprise which is delegated as the public road manager in accordance with the valid regulations, the Customs Administration is in charge of the collection of fees for state road usage for foreign vehicles.

Pursuant to Article 17 of the Law on Public Roads, public road usage shall be charged, i.e. fee for state road usage for foreign vehicles shall be collected.

Pursuant to Article 18 , the amount of fee stated under Article 17, item 1) and 13) of this Law shall be determined by the Government.

Pursuant to Article 19, the funds stated under Article 16, item 2) of this Law shall be registered in the special account of the Treasury of the Republic of Serbia.

The Ministry shall transfer the funds stated under paragraph 1 of this Article into the account of the Public Enterprise which uses such funds for the maintenance and protection of state roads.

Pursuant to Article 20 , the collection of fee stated under Article 17, item 13) of this Law shall be organized by the Public Enterprise on border crossings, and shall be determined with specific regulations.

Pursuant to the Decision on the fee for foreign vehicles using roads in the FRY (published in the “Official Gazette of the FRY” No. 36/92, 4/98 and 7/98), there are:

Fee for road usage stated in item 1 of this Decision, expressed in US dollars in the following manner:

- Truck, trailer and semi- trailer per each gross tone kilometer  0,0030 US dollars

Bus and bus trailer per each kilometer:
- For vehicles of up to 30 seats 0,0320 US dollars
- For vehicles of over 30 seats 0,0410 US dollars
- For other vehicles (service vehicles – fire vehicles, cleaning vehicles, car cranes, disinfection vehicles, tractors - agricultural, road and working
machines, self-propelled or with own wheels etc.) per each gross tone kilometer
0,0041 US dollars
- For vehicles with a special permit issued by the customs authority in accordance with Article 38 of the Law on Transport in International
Road Traffic, the fee is determined in compliance with the provisions under item 2 of this Decision
increased for 20%

Billboards

BilbordPursuant to Article 14, paragraph 7 of the Law on Public Roads, authorities shall be delegated to the public road manager to issue approvals for the placement of billboards, advertising boards, and devices for visual and audio advertising or announcing on public roads and/or along it.

If the traffic and technical conditions stated by the PE “Roads of Serbia” are fulfilled, and prior to the issuance of approval for the placement of billboards, advertising boards, and devices for visual and audio advertising or announcing on public roads and/or along it, a special contract will determine and regulate the charge collection in accordance with the Decision on the amount of fees for state road usage (“Official Gazette of the Republic of Serbia”, No. 16, dated March 16th, 2009.)

Pursuant to Article 17, item 4 of the Law on Public Roads, and in accordance with legal regulations, the Public Enterprise “Roads of Serbia” executes the charge collection for the placement of billboards, advertising boards, and devices for visual and audio advertising or announcing on public roads and/or any other land.

Charge collection realization for public road users upon obtaining approval

Pursuant to Article 14 of the Law on Public Roads, authorities shall be delegated to the public road manager to issue the following:

  • approval for the construction and rehabilitation of an access junction to a public road;
  • approval for the construction and/or laying of water mains, sewers, heating systems, railway line and other similar structures as well as telecommunication and electrical lines, installations, facilities and the like on a public road and in the protection zone of a public road;
  • approval for the modification of traffic areas within the facilities along a public road;
  • approval for the performance of sport and other events on a public road;
  • special permit for special transport on a public road;
  • approval for the placement of billboards, advertising boards, and devices for visual and audio advertising or announcing on public roads and/or along it

Important notice: Charge collection realization is executed upon obtaining relevant approval.

In accordance with the Decision on the amount of fees for state road usage (“Official Gazette of
the Republic of Serbia” No.16, dated March 06th, 2009), the Department for Commercial Affairs
is in charge of executing the charge collection realization for public road users in the following manner:

One-time fees:

  • for the construction of commercial objects – petrol stations, independent petrol stations with liquid oil gas, motels, hotels, restaurants, car repair services, shops, depots, dump landfills, megastores and other commercial facilities (Article 7)
  • for the construction of an access road connection to a state road (Article 5)
  • for the placement of water mains, sewage, electric, telephone and telegraph lines, and similar utilities (Article 6)

Annual fees:

  • for renting the portions of land strip and/or any other land used by the Enterprise in a settlement, which is being used for the access to facilities and their construction (petrol stations, independent petrol stations with liquid oil gas, motels, hotels, restaurants, car repair services, shops, depots, dump landfills, megastores and the like (Article 3)
  • for renting any other land used by the Enterprise, which is being used for agricultural purposes (Article 4)
  • for the use of commercial objects which are provided with an access from a state road (Article 8)

The method of annual fees’ payment is in 12 equal monthly installments by the 5th day of the current month for the previous month.

  • monthly fee for the placement and use of temporary (seasonal) commercial objects (containers, kiosks, caravan vehicles, mobile shops etc.)

FREQUENTLY ASKED QUESTIONS (FAQs) RELATING TO CHARGE COLLECTION REALIZATION FOR PUBLIC ROAD USERS

Question: Is the payment in installments possible for outstanding claims?
Answer: Outstanding claims cannot be paid in installments; the Decision on the amount of fees for state road usage determines the method of payment of fees.

Question: Who should one contact in case of dissolution of a commercial object?
Answer: In case of altered circumstances (i.e. change of commercial object owner, object put out to lease, dissolution of a commercial object, object expansion or reduction), it is necessary to inform the Department for Commercial Affairs of the PE “Roads of Serbia”.

Question: Is interest charged for unsettled claims, and on what grounds?
Answer: Pursuant to Article 26 of the Law on Public Roads, as regards the controlling procedures, interest charges, refund, extinctive prescription and other not stipulated in this Law, the provisions of the law on Taxing Procedure and Tax Administration shall apply, whereas Article 71 and Article 75 of this Law determine the method of charging interest in more detail.

Question: How can temporary (seasonal) commercial object be defined?
Answer: Temporary (seasonal) commercial objects include containers, kiosks, caravan vehicles, mobile shops, etc.

Question: Which authorizing institution should be informed upon obtaining the use permit for the official commencement of operation for the commercial object?
Answer: Upon obtaining the construction permit and the official registration of works, i.e. the commencement of usage of the structural complex or its part, the contractual obligation undertaken by another contracting party is to inform in written form the Department for Commercial Affairs of the PE “Roads of Serbia” within 15 days from the date of commencement of usage.
